Book Of Shadows... Need your help girlzzz

Hi there ! I'm coming here to ask your help... A friend of mine got a Book of Shadow palette for Christmas, and by surfing on different beauty blogs, she realized that hers is not the same as the others...
Some eyeshadow colors are actually duplicate and so, she doesn't have some of the colors... (you an see pictures of her palette here : http://www.servimg.com/image_preview.php?i=76&u=12556408

Knowing that the great side of this palette is the number of different eyeshadow in only one packing...
She doesn't speak english, so i wrote with her 2 emails that we sent through Urban Decay contact form on their web site because the French distributor of Urban Decay says that he can't do anything as it's a limited edition...
So 2 weeks ago, we sent this first email :

I really hope you understand my disappointment, knowing that it's a present… It's obvious that there was a mistake in the production chain of the palette.

I understand that not having the bill might be a problem for you, but on the other hand, I think you'd honestly reckon that this palette shall not have been released as it is from the factory.

Thus, I'm asking you to change it, or eventually, send me the missing eye shadows if changing was not possible.

After a week, still no answer, so we decided to write another email, with the help of a friend working for a law company...

Tomorrow is the 15th and we still don't have any answer... So as UD headquarter is in the state, do you know any consumer association we could contact to have a bit of weight in front of them ? Or maybe as usually the US packaging are different from the Export packaging (legal matters...), maybe you can find a consumer friendly address on yours ?

There are several different types of palettes for Urban Decay. Maybe your friend got one that is now discontinued and not available everywhere, which is why hers looks different. If the palette is authentic, which I think it is since it was purchased at Sephora, there is nothing you can threaten that person with legally, because it's not a legal issue.

I think you and your friend are a bit full of yourselves if you think you can threaten to take legal action over a $30 make up palette just because you didn't get the colors that you wanted. If there is nothing wrong with the palette, which their isn't, there's no need for them to respond to your threats.

ETA: I see the defect now and I understand the issue, but the legal issue and being full of yourselves comment still stands.

Whoa, that is crazy! Definitely defective. I can see that you've got duplicates of Gridlock and Scandal and are missing Grifter and Sidecar.

But come on! There isn't really anything you can do about this. How can Urban Decay replace your palette or send you the missing colors if it is limited edition and they no longer have any? Plus, it would be Sephora's responsibility to replace the palette. It is unfortunate that they cannot since it was an LE item. And it is also unfortuante that you cannot get your money back because you don't have a receipt. I don't understand why you just don't exchange the defective palette for something else from Sephora? You should be able to take store credit, unless the rules are different at the Sephora in France.

I'm sorry that you're not going to be able to have a non-defective palette, but threatening Urban Decay with legal action because of it is just rediculous. Its out of anyone's control and you should suck it up and move on. There is nothing that can be done to replace your palette and you need to accept that. If you want it that bad, why don't you find it on Ebay or something?

I would return the palette to Sephora for store credit. If you still want the palette, look for it in the Clearance Bin here, on MUA or LJ. Maybe you can post an ISO. I saw people selling it once in a while.

what a total bummer. i hope she kept it though since those are basically extinct palettes but hope she got something in return as well, what a bummer. any update??
